Article 1: General

The following terms and conditions of delivery and payment apply to all offers from Vibez.

In addition to these general terms and conditions, Vibez may apply supplementary terms that are specifically applicable to the type of transaction or nature of the work. Such supplementary terms form part of these general terms and conditions.

The terms stated herein shall at all times prevail over those of the buyer, regardless of whether the buyer's terms conflict with or deviate from Vibez's terms.

Article 2: Formation of the agreement

The purchase agreement is concluded upon receipt by Vibez of the signed order confirmation via email, the internet, telephone, or otherwise.

Vibez has the right to refuse orders or assignments without providing reasons, or to accept them only under the condition that shipment occurs after prepayment, in which case the buyer will be informed accordingly.

Article 3: Quotations

Vibez’s price lists do not constitute a quotation.

Quotations are provided exclusively upon special request and have a validity period of 7 days unless otherwise indicated.

Quotations are non-binding unless otherwise stated in the quotation.

Article 4: Offers

All offers listed on the Vibez website are valid as long as they are displayed on the site.

Vibez reserves the right to implement price changes to its offers.

Article 5: Prices

All prices on the Vibez website include 21% VAT.

Products are priced as stated on the Vibez website or in issued quotations, subject to typing or printing errors. Vibez has the right to inform the buyer of such errors before delivery.

Vibez products are delivered at the prices applicable on the date of the order.

Transactions between businesses outside the Netherlands with a valid VAT number and Vibez may be processed under intra-Community regulations.

Article 6: Images

All images, drawings, and data concerning weights, dimensions, colors, etc., included on the website are approximate and cannot be grounds for compensation and/or dissolution of an agreement.

The images shown are a digital representation of the article. The colors depicted may differ from reality on your screen. No rights may be derived from the displayed images with regard to color and proportion.

Article 7: Payment

As a general rule, delivery takes place after payment has been received, unless expressly agreed otherwise. Payment can be made via advance bank transfer to our account.

In the event that Vibez sends an invoice to customers/purchasers with whom it has been agreed that they may pay on account, payment must be made within 7 days of the invoice date, unless agreed otherwise in writing.

If the buyer has not paid the invoice by the due date, the buyer is in default without prior notice of default and owes Vibez interest of 1.5% on the outstanding amount per month, with a partial month being counted as a full month.

In the event of non-payment, Vibez is entitled to hand the case over for collection. As soon as Vibez has done so, all judicial and extrajudicial costs shall be borne entirely by the debtor.

Complaints and/or warranty claims processed do not grant the right to defer payment or make partial payments.

Article 8: Shipment

Products are shipped at the risk of Vibez, unless the buyer has arranged the transport themselves. The buyer bears the risk for the products from the moment they are offered for receipt at the specified address.

The buyer is obliged to accept the products upon delivery. In the absence thereof, the products will be stored by the courier service. The costs associated with this are for the buyer's account as stated below.

If the buyer refuses to accept the products upon delivery, they will be returned to Vibez, possibly after storage by the courier service.

Article 9: Delivery

For payments via invoice, upon receipt of the purchase price in our account, delivery takes place by shipping your order within seven business days. If the delivery time exceeds 14 business days, the buyer will be notified of this, including the reason for the delay.

The specified delivery times are not final deadlines and are to be understood as a best-effort obligation and are deemed to be provided approximately.

Exceeding a delivery term never gives the buyer the right to any compensation, dissolution of the agreement, or any other action against Vibez.

Ordered products can also be picked up at the warehouse.

Article 10: Warranty

Vibez guarantees the high quality of the services it provides and the soundness and good quality of the delivered products, with the understanding that the warranty does not extend beyond the provisions set out below.

A 12-month structural warranty is provided on delivered rim products, unless stated otherwise.

You have the right to have rims purchased from Vibez examined if you are of the opinion that they are technically unsound. Claims can be submitted up to 1 month after the invoice date. If a claim is upheld, we will not charge any costs for the examination and will credit the goods in question. If, after investigation, it appears that you have incorrectly reported a product as a claim, we will charge 25 euros in examination costs per product. If you also had the products collected by us, we will also charge you for the logistical costs; this naturally only applies in the event that the claim is rejected. If the claim is upheld, we will bear all logistical costs and credit the rims to you. If we credit the goods, they will not be returned to you. If the claim is rejected and you wish to receive the goods back, shipping costs will be charged again.

If the shipment is offered to you with apparent damage to the packaging, contents, or otherwise, report this immediately upon delivery to the courier and within 24 hours to Vibez. Always ask the courier to make a note of this damage. Do not mount the rim set before you have contacted Vibez regarding potential next steps. Once it is determined whether the damage occurred during transport or mounting, the replacement of the damaged products will be carried out in consultation with the customer. Claims for damage upon receipt cannot be made for rims and tires that have already been mounted on your vehicle. It is therefore advisable to inspect the rims immediately upon receipt.

Perceptible deficiencies or defects in products must be reported to Vibez immediately after receipt or installation. Any form of liability for this may be rejected after these products have been used.

Should the defects be caused by the buyer, all repair and shipping costs are for their account.

The buyer cannot invoke the warranty provisions:

If the buyer has neglected the products.

If the buyer has made or had changes made to the products, including repairs not performed by or on behalf of Vibez.

In case of improper or careless use, incorrect mounting, damage through the influence of moisture or other external causes or disasters.

In case of damage caused by the influence of substances such as brine and salts.

If the product has not been maintained in the usual manner or as described in the user manual.

If the product is used with inferior or incorrect accessories.

Costs incurred due to a defect or a missing product cannot be recovered from Vibez without prior contact with Vibez. Vibez will inform you in writing about the agreements made.

Article 11: Retention of title

Ownership of products delivered by Vibez is expressly reserved until the full purchase price has been paid.

Article 12: Trademark

Factory or trade marks or type or identification numbers or signs applied to the products delivered by Vibez may not be removed, damaged, or altered. Any alteration, of whatever kind, voids the warranty.

Article 13: Limitation of liability

Vibez accepts no responsibility for damage to other products of the buyer or third parties which is directly or indirectly caused by a defect in a delivered product.

Vibez is in no way liable for damage to products caused by incorrect handling, incompetence, incorrect mounting, misuse, or use outside of specifications.

Furthermore, Vibez accepts no liability for any damage whatsoever caused by irresponsible or unsafe use, in any form, whether the car is moving or stationary.

The customer is always responsible for the accuracy of their purchased specifications. Before and after the purchase, the customer must personally check whether the purchased products correspond to or fall within the tolerances described in the certificate of conformity or the purposes for which the products are intended.

Article 14: Force majeure

If Vibez cannot fulfill its obligations to the buyer due to force majeure, the fulfillment of those obligations will be suspended for the duration of the force majeure situation.

If the force majeure lasts for 1 month, both parties have the right to dissolve the agreement in whole or in part in writing, insofar as the force majeure situation justifies this.

In case of force majeure, the buyer has no right to any compensation, even if Vibez might have gained any benefit as a result of the force majeure.

Vibez will inform the buyer as soon as possible of any (imminent) force majeure.

Article 15: Dissolution

If the buyer fails to fulfill their obligations to Vibez, or fails to do so on time or properly, as well as if their bankruptcy is applied for, they are declared bankrupt, they apply for a suspension of payments, or offer a settlement or arrangement to their creditors or a part of them, furthermore in case of seizure of their assets or a part thereof, or if they proceed to sell or liquidate their business, as well as in the event of death, guardianship, or if they otherwise lose the management or control of their business, products, or a part thereof, the buyer is in default by operation of law and every claim that Vibez has against them is immediately and entirely due and payable without any notice of default being required.

In the cases mentioned under 1, Vibez has the right, without any notice of default, to suspend the further execution of the agreement on its part or to dissolve it in whole or in part or to make use of the provisions in Article 11.

Vibez is at all times authorized to claim compensation from the buyer, as well as to take back the delivered products.

In the event the buyer wishes to dissolve the agreement, they shall at all times first put Vibez in default in writing and grant it a reasonable period to still fulfill its obligations, or to repair deficiencies, which deficiencies the buyer must describe accurately in writing.

The buyer is not entitled to dissolve the agreement in whole or in part or to suspend their obligations if they were already in default of fulfilling their own obligations.

In the event of partial dissolution, the buyer cannot claim reversal of services already performed by Vibez, and Vibez retains full entitlement to payment for the services it has already performed.

With regard to the Distance Selling Act, private customers are entitled to a legally regulated cooling-off period of 7 days to return products purchased in unused and impeccable, resalable condition. For cancellation fees, see Article 16.1

Article 16: Cancellation and return

The buyer is entitled to cancel or return a rim set ordered online within 7 days of purchase, provided it is in its original packaging and in new condition without any traces of use or mounting!

Article 17: Applicable law

This agreement is governed by Dutch law. In case of disputes, both parties shall turn to the Court.
